At its core, the rule is simple: if a program wants to maintain access to federal student loans, its graduates should earn more than someone with only a high school diploma.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">But as soon as the rule was released, <\/span><a href=\"https:\/\/www.modernsalon.com\/1097189\/americas-beauty-and-wellness-industry-under-threat-from-proposed-regulations-now\"><span style=\"font-weight: 400;\">the cosmetology education industry pushed back<\/span><\/a><span style=\"font-weight: 400;\">, urging beauty and barbering schools <\/span><a href=\"https:\/\/urldefense.com\/v3\/__https:\/mkla9babb.cc.rs6.net\/tn.jsp?f=001rNsI9hPs4Grbjq4JEzGVykbZrddgthJ1d1evHH8GCNN3H0KXfj_2qPtugEFKMYFovCnRjZ7nYmbhbHphGhmuSLfXm6LEPRLDMqUeGwhrWsqmZicVv4C8nr7rx5_3_82I8u2jEbb4OTSx35X6_FNhJFMR2WuTsA75qI1N-BJqFFWPx4AZ6HvpO0Njp1HIneiuK4Wg4je9htyMDr_jUWPy8Q==&amp;c=vkoJ-I37HkiBgRcYvLWl5aSOsthslDhAY6_HHM6tixg78YbTkTFkEQ==&amp;ch=f8tfahdRsP61BUSJhyiD7eJ0Egu9IY6WN0d92r0Yhj7uAOyk-q5avw==__;!!Db6frn15oIvDD3UI!kwpyuJuffUny6yrJusKxKJb9i4p7-_6ErmPdPW0TJmMXlBKEmawEqtEFhBh7fFXMpz5izQt96LntUK8KFU7pmWqIVOQ1CQZGxgv98mk$\"><span style=\"font-weight: 400;\">to call for a weaker rule<\/span><\/a><span style=\"font-weight: 400;\"> and to gut the accountability provisions entirely so that outcomes data is used for informational purposes only. <\/span><a href=\"https:\/\/www.newamerica.org\/insights\/cut-short-the-broken-promises-of-cosmetology-education\/\"><span style=\"font-weight: 400;\">This isn\u2019t new for this sector.<\/span><\/a><span style=\"font-weight: 400;\"> As <\/span><a href=\"https:\/\/www.newamerica.org\/insights\/cut-short-the-broken-promises-of-cosmetology-education\/\"><span style=\"font-weight: 400;\">our research has shown<\/span><\/a><span style=\"font-weight: 400;\">, the cosmetology education industry is backed by a powerful lobby that tries to preserve its access to federal aid despite a poor track record of being good stewards of that investment. <\/span><a href=\"https:\/\/cases.justia.com\/federal\/district-courts\/district-of-columbia\/dcdce\/1:2017cv00263\/184377\/30\/0.pdf?ts=1498739428\"><span style=\"font-weight: 400;\">The industry has sued the Education<\/span><\/a> <a href=\"https:\/\/www.republicreport.org\/wp-content\/uploads\/2024\/01\/AACS-v-Cardona-complaint.pdf\"><span style=\"font-weight: 400;\">Department repeatedly over any accountability rules<\/span><\/a><span style=\"font-weight: 400;\">, it has <\/span><a href=\"https:\/\/www.newamerica.org\/insights\/cut-short-the-broken-promises-of-cosmetology-education\/from-salon-to-senate-cosmetologys-lobbying-power\/\"><span style=\"font-weight: 400;\">blamed the demographics of their students<\/span><\/a><span style=\"font-weight: 400;\"> as a driving reason for their poor outcomes, and has <\/span><a href=\"https:\/\/www.newamerica.org\/insights\/cut-short-the-broken-promises-of-cosmetology-education\/held-in-place-locking-in-state-licensure-mandates\/\"><span style=\"font-weight: 400;\">lobbied to keep licensure hours high<\/span><\/a><span style=\"font-weight: 400;\">, while fighting to keep <\/span><a href=\"https:\/\/www.newamerica.org\/insights\/cut-short-the-broken-promises-of-cosmetology-education\/held-in-place-locking-in-state-licensure-mandates\/\"><span style=\"font-weight: 400;\">low-cost providers<\/span><\/a><span style=\"font-weight: 400;\"> and pathways at community colleges or <\/span><a href=\"https:\/\/www.newamerica.org\/insights\/cut-short-the-broken-promises-of-cosmetology-education\/a-new-look-rethinking-licensure-pathways\/\"><span style=\"font-weight: 400;\">through registered apprenticeships<\/span><\/a><span style=\"font-weight: 400;\"> out of cosmetology education altogether.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">It should not be a surprise that industry advocates are advancing claims about this new accountability rule that don\u2019t hold up. Just over 9 in 10 cosmetology and barbering programs would fail the new earnings premium metric, according to the American Association of Cosmetology Schools\u2019s <\/span><a href=\"https:\/\/urldefense.com\/v3\/__https:\/mkla9babb.cc.rs6.net\/tn.jsp?f=001rNsI9hPs4Grbjq4JEzGVykbZrddgthJ1d1evHH8GCNN3H0KXfj_2qPtugEFKMYFovCnRjZ7nYmbhbHphGhmuSLfXm6LEPRLDMqUeGwhrWsqmZicVv4C8nr7rx5_3_82I8u2jEbb4OTSx35X6_FNhJFMR2WuTsA75qI1N-BJqFFWPx4AZ6HvpO0Njp1HIneiuK4Wg4je9htyMDr_jUWPy8Q==&amp;c=vkoJ-I37HkiBgRcYvLWl5aSOsthslDhAY6_HHM6tixg78YbTkTFkEQ==&amp;ch=f8tfahdRsP61BUSJhyiD7eJ0Egu9IY6WN0d92r0Yhj7uAOyk-q5avw==__;!!Db6frn15oIvDD3UI!kwpyuJuffUny6yrJusKxKJb9i4p7-_6ErmPdPW0TJmMXlBKEmawEqtEFhBh7fFXMpz5izQt96LntUK8KFU7pmWqIVOQ1CQZGxgv98mk$\"><span style=\"font-weight: 400;\">analysis of Education Department data.<\/span><\/a><span style=\"font-weight: 400;\"> This will likely cause programmatic and institutional closures for those reliant on federal student loans to operate. But these rules are designed to ensure that students enrolling in programs that result in low earnings are not taking on taxpayer-funded loans they may be unlikely to repay.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Below, we break down falsehoods in the industry's most common claims:<\/span>\r\n\r\n<strong>Claim: These rules will shut down the cosmetology pipeline<\/strong>\r\n<strong>Fact: the pipeline is more than just programs that receive federal student aid<\/strong>\r\n\r\n<span style=\"font-weight: 400;\">The cosmetology and barbering education pipeline is broader than programs that receive federal student loans. <\/span><a href=\"https:\/\/www.peer-center.org\/research\/cosmetology-schools-everywhere\"><span style=\"font-weight: 400;\">Many cosmetology schools already operate without federal subsidies<\/span><\/a><b>. <\/b><span style=\"font-weight: 400;\">Alternative pathways such as <\/span><a href=\"https:\/\/adulted.lausd.org\/apps\/pages\/index.jsp?uREC_ID=4456031&amp;type=d&amp;pREC_ID=2717079\"><span style=\"font-weight: 400;\">high school career and technical education programs<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.newamerica.org\/insights\/cut-short-the-broken-promises-of-cosmetology-education\/a-new-look-rethinking-licensure-pathways\/\"><span style=\"font-weight: 400;\">registered apprenticeships<\/span><\/a><span style=\"font-weight: 400;\"> allow students to train for licensure at low or no cost, sometimes while earning an income. The question isn\u2019t whether cosmetology and barbers will continue to be trained, it\u2019s whether taxpayers should continue subsidizing programs through federal student loans that consistently leave students with low wages that don\u2019t even surpass a high school graduate. Even if the program fails new earnings tests, it may still maintain access to the Pell Grant to help students defray costs so long as a majority of a school\u2019s revenue isn\u2019t from failing programs. Programs can, and will, still operate, but access to federal student loans should come with a basic expectation of being able to pay those loans off.\u00a0<\/span>\r\n\r\n<strong>Claim: Earnings data are flawed because cosmetologists underreport tips received<\/strong>\r\n<strong>Fact: Unreported income is not enough to change outcomes<\/strong>\r\n\r\n<span style=\"font-weight: 400;\">The \u201chidden income\u201d argument <\/span><a href=\"https:\/\/www.federalregister.gov\/d\/2026-07666\/p-375\"><span style=\"font-weight: 400;\">is a longstanding industry tactic<\/span><\/a><span style=\"font-weight: 400;\"> to avoid accountability. And now that argument is even more meaningless with no more taxes on tips through the <\/span><i><span style=\"font-weight: 400;\">One Big Beautiful Bill Act. <\/span><\/i><span style=\"font-weight: 400;\">However, even before the no tax on tips, <\/span><a href=\"https:\/\/www.reginfo.gov\/public\/do\/viewEO12866Meeting?viewRule=true&amp;rin=1840-AD57&amp;meetingId=193423&amp;acronym=1840-ED\/OPE\"><span style=\"font-weight: 400;\">industry surveys showed<\/span><\/a><span style=\"font-weight: 400;\"> most barbers and cosmetologists reported tips on W-2s. And <\/span><a href=\"https:\/\/www.peer-center.org\/research\/hair-and-taxes\"><span style=\"font-weight: 400;\">IRS-based research<\/span><\/a><span style=\"font-weight: 400;\"> showed that unreported income only accounts for about an 8 percent increase in earnings, which is not enough for a program to pass the earnings test. This sort of independent research should be trusted over the <\/span><a href=\"https:\/\/www.peer-center.org\/research\/hair-and-taxes\"><span style=\"font-weight: 400;\">industry that has inflated self-reported earnings<\/span><\/a><span style=\"font-weight: 400;\"> by 82 percent, which is just not credible given the administrative data available.<\/span>\r\n\r\n<strong>Claim: The rule disproportionately impacts programs that serve women and minority students<\/strong>\r\n<strong>Fact: The rule protects women and minority students from taking on debt for programs that they may never be able to afford repaying<\/strong>\r\n\r\n<span style=\"font-weight: 400;\">Approximately <\/span><a href=\"https:\/\/tcf.org\/content\/report\/cosmetology-training-needs-a-make-over\/\"><span style=\"font-weight: 400;\">ninety percent of cosmetology program graduates are women<\/span><\/a><span style=\"font-weight: 400;\">, including large shares of students of color and parenting students. <\/span><a href=\"https:\/\/www.newamerica.org\/insights\/student-parents-in-cosmetology-programs-matter\/\"><span style=\"font-weight: 400;\">One in three<\/span><\/a><span style=\"font-weight: 400;\"> cosmetology students are parents. Despite their major presence in cosmetology programs, these students are often poorly served and left saddled with debt that they struggle to repay, making it a real challenge to provide for their families. This new accountability rule is intended to <\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/04\/20\/2026-07666\/accountability-in-higher-education-and-access-through-demand-driven-workforce-pell-student-tuition#p-729\"><span style=\"font-weight: 400;\">protect students from borrowing for high-cost, predatory programs<\/span><\/a><span style=\"font-weight: 400;\">, not harm their beauty career aspirations. The same actors warning about the \u201charm\u201d of this rule to women and minority student populations are the same ones who have <\/span><a href=\"https:\/\/www.newamerica.org\/insights\/cut-short-the-broken-promises-of-cosmetology-education\/the-dirty-mirror-schools-operate-despite-scandals\/\"><span style=\"font-weight: 400;\">historically resisted change<\/span><\/a><span style=\"font-weight: 400;\"> that would strengthen these students' outcomes. The Education Department has found that they are the ones who <\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/10\/10\/2023-20385\/financial-value-transparency-and-gainful-employment\"><span style=\"font-weight: 400;\">aggressively recruit women or students of color<\/span><\/a><span style=\"font-weight: 400;\">, and then <\/span><a href=\"https:\/\/www.newamerica.org\/insights\/cut-short-the-broken-promises-of-cosmetology-education\/from-salon-to-senate-cosmetologys-lobbying-power\/\"><span style=\"font-weight: 400;\">blame their resulting poor outcomes on student demographics<\/span><\/a><span style=\"font-weight: 400;\">. Outcomes in cosmetology lag behind similar programs that have a similar racial and gender balance, such as practical nursing and dental support, which <\/span><a href=\"https:\/\/www.regulations.gov\/document\/ED-2023-OPE-0089-3916\"><span style=\"font-weight: 400;\">have much higher passage rates<\/span><\/a><b>.<\/b>\r\n\r\n<strong>Claim: Graduates choose part-time work, so earnings are low<\/strong>\r\n<strong>Fact: Loans must be repaid regardless of whether a graduate works part-time or not<\/strong>\r\n\r\n<span style=\"font-weight: 400;\">If typical earnings in a field are too low to support manageable repayment, it\u2019s not worth a student going into debt. After all, repayment obligations never adjust based on hours worked. Federal student loans should not support programs that consistently leave students with unaffordable debt relative to what they are likely to earn. In an occupation that potentially leads to mostly part-time employment, students should not have to take on substantial debt to access that training. Instead, programs should be structured and priced in a way that reflects realistic labor market outcomes. The new accountability rules could drive reform of the cosmetology education system by lowering tuition costs, and promoting innovative pathways to the career such as registered apprenticeships and career and technical education at the high school level.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Ultimately, the claims made by the cosmetology education industry underscore the need for accountability that aligns program costs with real-world outcomes. Accountability is about establishing a commonsense minimum bar. Strong accountability standards <\/span><a href=\"https:\/\/www.newamerica.org\/insights\/blog-series-gainful-employment\/\"><span style=\"font-weight: 400;\">help steer students toward better options and push underperforming programs to improve and innovate<\/span><\/a><span style=\"font-weight: 400;\"> or risk losing access to taxpayer dollars. That innovation could include lower tuition, different pathways, or apprenticeship-based models that reflect real workforce conditions for the barbering and cosmetology sector.
