Heirs property homes and land are passed down through generations without formal documentation, leaving ownership informally shared among multiple heirs and largely unrecorded in land records. This arrangement has drawn growing attention from funders, nonprofits, policymakers, and governments at every level\u2014and for good reason. While heirs property represents an enormous source of wealth for low-income communities, it is also an inherently risky form of ownership that leaves families <\/span><a href=\"https:\/\/www.nclc.org\/wp-content\/uploads\/2024\/01\/Report-Heirs-Property-Keeping-it-in-the-Family.pdf\"><span style=\"font-weight: 400;\">vulnerable to loss<\/span><\/a><span style=\"font-weight: 400;\">. The collective value of these properties is conservatively estimated at between <\/span><a href=\"https:\/\/www.fanniemae.com\/sites\/g\/files\/koqyhd191\/files\/2023-12\/heirs-property-research-report_0.pdf\"><span style=\"font-weight: 400;\">$32 billion<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/research.fs.usda.gov\/treesearch\/66881#:~:text=Abstract,issues%20associated%20with%20heirs'%20property.\"><span style=\"font-weight: 400;\">$41 billion<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/lawmagazine.bc.edu\/2024\/05\/the-lurking-dangers-of-heirs-property\/\"><span style=\"font-weight: 400;\">likely much more<\/span><\/a><span style=\"font-weight: 400;\">. Yet because ownership is undocumented and fractured among several owners, the families who hold this wealth have few protections to defend it.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">The movement to protect heirs property from the risk of exploitation and distressed partition sales has <\/span><a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=6233499\"><span style=\"font-weight: 400;\">grown exponentially<\/span><\/a><span style=\"font-weight: 400;\"> over the past 20 years, thanks to <\/span><a href=\"https:\/\/www.hppn.info\/\"><span style=\"font-weight: 400;\">tireless advocates<\/span><\/a><span style=\"font-weight: 400;\"> and a <\/span><a href=\"https:\/\/www.uniformlaws.org\/committees\/community-home?CommunityKey=50724584-e808-4255-bc5d-8ea4e588371d\"><span style=\"font-weight: 400;\">uniform law<\/span><\/a><span style=\"font-weight: 400;\"> spearheaded by <\/span><a href=\"https:\/\/www.bc.edu\/bc-web\/schools\/law\/academics-faculty\/faculty-directory\/thomas-mitchell.html\"><span style=\"font-weight: 400;\">Thomas Mitchell<\/span><\/a><span style=\"font-weight: 400;\"> and promoted by the Uniform Law Commission.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Local governments have now joined the efforts to address heirs property, as an issue of housing insecurity as well as generational-wealth building. Cities like <\/span><a href=\"https:\/\/www.phila.gov\/services\/property-lots-housing\/foreclosure-sheriff-sales\/apply-for-a-grant-to-clear-your-homes-title\/#:~:text=The%20Tangled%20Title%20Fund%20(TTF,visit%20the%20Tangled%20Title%20Fund.\"><span style=\"font-weight: 400;\">Philadelphia<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.jacksonville.gov\/departments\/property-appraiser\"><span style=\"font-weight: 400;\">Jacksonville<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/detroitmi.gov\/news\/city-detroit-and-gilbert-family-foundation-announce-free-estate-planning-will-preparation-and\"><span style=\"font-weight: 400;\">Detroit<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/chsainc.org\/heirs-property-program\/\"><span style=\"font-weight: 400;\">Savannah<\/span><\/a><span style=\"font-weight: 400;\"> have launched initiatives including wills clinics and community education events. Some cities have even funded legal services to help heirs clarify their ownership.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Public servants are recognizing the value proposition of protecting and resolving heirs property\u2014a return on investment some have estimated at <\/span><a href=\"https:\/\/assetfunders.org\/resource\/heirs-property-investing-to-preserve-wealth\/\"><span style=\"font-weight: 400;\">up to 36 to 1<\/span><\/a><span style=\"font-weight: 400;\">. They know that promoting stable homeownership is good for communities and keeping long-time homeowners in their homes is more affordable than having to provide subsidized rental housing or emergency services for unhoused families.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Yet the single biggest way local governments could protect heirs property owners from loss remains largely undiscussed: making their property tax relief programs <\/span><a href=\"https:\/\/www.nclc.org\/resources\/property-tax-foreclosures-on-heirs-property-the-devastating-consequences-and-recommendations-for-prevention\/\"><span style=\"font-weight: 400;\">accessible to heirs property owners<\/span><\/a><span style=\"font-weight: 400;\"> and increasing their uptake.\u00a0<\/span>","":null,"drop_cap":false,"anchor_id":""}},{"acf_fc_layout":"layout_pull_quote","_acfe_flexible_toggle":null,"component_pull_quote":{"display_variation":"left","quote":"Yet the single biggest way local governments could protect heirs property owners from loss remains largely undiscussed: making their property tax relief programs accessible to heirs property owners and increasing their uptake.","image":"","meta":{"name":"","role":"","work":""},"":null,"anchor_id":""}},{"acf_fc_layout":"layout_wysiwyg","_acfe_flexible_toggle":null,"component_wysiwyg":{"add_background_color":false,"content":"<span style=\"font-weight: 400;\">Every state in the country provides some kind of owner-occupant property tax relief. The vast majority of states provide a basic level of relief for all owner-occupants, known as the principal residence or \u201chomestead\u201d exemption or abatement. All states provide an extra level of tax relief for older-adult homeowners, and many provide additional relief based on income, disability, or veteran status. In many places, these discounts are significant, reducing annual property tax bills by half or even more. They may come with an assessment freeze that enables long-time homeowners to avoid an escalating tax bill as they age in the home. In many places, the taxing authority has begun to pull owner-occupied properties off the tax foreclosure list.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Yet owner-occupants living in heirs property generally do not obtain any of this crucial relief. <\/span><a href=\"https:\/\/assetfunders.org\/resource\/the-impacts-of-heirs-property-on-homeowners-in-north-texas\/\"><span style=\"font-weight: 400;\">One study<\/span><\/a><span style=\"font-weight: 400;\"> showed that over half of the residential properties in tax foreclosure in two Texas counties were heirs properties.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Families who own heirs property tend to be poorer and have less experience and resources to navigate probate and other inheritance processes. As a result, heirs of a deceased homeowner often don\u2019t know about the property tax relief they could apply for, how to apply, or how much of a difference it could make in their annual tax bill. Heirs are carrying the burden of grieving a loved one, paying for funeral and burial expenses, and often facing a loss of income that the deceased person had contributed. They have likely never gone through a first-time homebuyer class or sat at a closing table where an attorney reminded them to apply for the homestead exemption and pay their property taxes.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Local governments could do more to help bring this information to light, but often do not. Counties <\/span><span style=\"font-weight: 400;\">make little effort to notify potential heirs that they could apply for a homestead exemption in their own names, and often bar heirs from applying for a homestead exemption until they have gone through the time-consuming and costly process of filing a probate action to legally get their names on the deed. The result is that families lose critical tax relief at precisely the moment they're most financially vulnerable.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">There\u2019s nothing illegal about heirs property ownership. Heirs inherit their interest in the home at the moment of the prior owner\u2019s death. The only issue is proof of that ownership. State laws say that \u201cowners\u201d occupying the home are eligible for homestead tax relief; and yet, in the execution, this becomes \u201conly owners whose name is already on the deed.\u201d Other proof of ownership, like an affidavit, should be sufficient, as cities like <\/span><a href=\"https:\/\/www.phila.gov\/documents\/homestead-affdavit\/\"><span style=\"font-weight: 400;\">Philadelphia<\/span><\/a><span style=\"font-weight: 400;\"> have shown.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">For heirs, the impact of losing out on homestead tax relief is dire. Their tax bill skyrockets and before long, the property starts spiraling down towards tax foreclosure.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Property tax foreclosure laws have been the focus of significant litigation in the past three years\u2014with a U.S. <\/span><a href=\"https:\/\/library.nclc.org\/article\/supreme-court-stops-equity-theft-property-tax-foreclosures\"><span style=\"font-weight: 400;\">Supreme Court decision<\/span><\/a><span style=\"font-weight: 400;\"> ruling 14 state laws <\/span><a href=\"https:\/\/www.nclc.org\/event\/property-tax-foreclosures-older-adults-tyler-v-hennepin\/\"><span style=\"font-weight: 400;\">unconstitutional<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/www.scotusblog.com\/cases\/case-files\/pung-v-isabella-county-michigan\/\"><span style=\"font-weight: 400;\">another challenge<\/span><\/a><span style=\"font-weight: 400;\"> to the system of tax foreclosures heard this spring and awaiting an opinion.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">The great unfairness of losing a home that is worth hundreds of thousands of dollars over a tax bill of less than $10,000 seems obvious, and has led to these legal challenges. While the litigation to date focuses on the tax foreclosure process, it is equally important to prevent properties from going into tax foreclosure to begin with, by ensuring broad access to available relief.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Local governments rely on property taxes to fund essential services, and so it's easy to understand their frustration towards property owners who fail to pay property taxes. On the other hand, ensuring that every household is getting the property tax relief they are entitled to under the law will allow more households to pay the taxes they owe\u2014and can actually afford. We should not be satisfied with unequal access to property tax discounts based on information and technology gaps.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Everyone entitled to owner-occupant tax relief <\/span><a href=\"https:\/\/www.nclc.org\/resources\/local-solutions-to-protect-heirs-property-owners-from-property-tax-foreclosure\/\"><span style=\"font-weight: 400;\">should get it<\/span><\/a><span style=\"font-weight: 400;\">. Here are three strategies that the National Consumer Law Center believes can work:<\/span>\r\n<ul>\r\n \t<li><b>Information campaigns are crucial, <\/b><span style=\"font-weight: 400;\">including multiple, proactive attempts to reach heirs. Counties should not remove an exemption without making every effort to determine whether the relief should be carried over to an heir living in the home.\u00a0<\/span><\/li>\r\n \t<li><b>Counties can review their tax rolls to look for people who are likely entitled to homestead relief<\/b><span style=\"font-weight: 400;\"> and not getting it: Any time the tax bill is going to the property address, there is a likelihood of owner-occupancy. It is well worth targeting the properties with a tax bill going to the home and no homestead exemption for additional outreach.\u00a0<\/span><\/li>\r\n \t<li><span style=\"font-weight: 400;\">Finally, <\/span><b>counties need processes that are accessible and easy for heirs to navigate<\/b><span style=\"font-weight: 400;\">. This means accepting applications year round; accepting applications when the name is not on the deed; and allowing affidavits as proof of ownership.
